Terms of service

DRAFT — not reviewed by a lawyer. Do not publish until it has had legal review.

Last updated: [DATE]

These terms are an agreement between you and [COMPANY LEGAL NAME] ("we", "us") for your use of the SpeedLead app and service. By creating an account you agree to them.

The service

SpeedLead collects leads from sources you connect, alerts your phone when they arrive, and can text your callback number when a lead waits. When you turn them on, it also sends automatic texts and emails to those leads using templates you control. Alerts depend on your phone, its settings (Do Not Disturb, battery saving, notification permissions), your network and third-party services, so we cannot guarantee that every alert is delivered or delivered on time. Do not rely on SpeedLead as your only way to receive leads.

Your account

  • You must be at least 18 and able to enter a contract for your business.
  • Keep your sign-in details safe. You are responsible for activity in your account.
  • Tell us promptly at [CONTACT EMAIL] if you think your account has been misused.

Your responsibilities for messages and leads

When you turn on automatic replies, you are the sender of the automatic texts and emails SpeedLead sends for you. You agree that:

  • you have a lawful basis and any consent required (for example under the TCPA in the US, CASL in Canada, or GDPR/PECR in the EU/UK) to contact each lead the way your auto-replies do;
  • your templates identify your business, are truthful, and keep the opt-out instruction (for example "Reply STOP to opt out");
  • you will not use SpeedLead for spam, marketing to purchased lists, harassment, or unlawful content;
  • you are responsible for the lead data you bring into SpeedLead and for answering your leads' privacy requests.

We honor STOP and START replies automatically. A number that opts out will not receive texts from any SpeedLead account.

Acceptable use

Do not: attempt to access other accounts' data; probe, overload or disrupt the service; reverse-engineer it except where the law allows; or use it to send messages to numbers that did not contact your business.

Fees

[PRICING, TRIAL AND BILLING TERMS — to be added when subscriptions launch. In-app purchases are billed by Apple or Google under their terms.] Text messages and emails may be subject to fair-use limits.

Your data

You own your data and your leads' data. You give us permission to store and process it only to provide the service, as described in our Privacy Policy. You can delete your account and its data at any time in Settings.

Suspension and termination

You can stop using SpeedLead and delete your account at any time. We may suspend or close accounts that break these terms, put other users or our sending reputation at risk, or are required to be closed by law. Where reasonable we will tell you first.

Disclaimers

The service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, including fitness for a particular purpose and that the service will be uninterrupted or error-free.

Limitation of liability

To the extent the law allows, we are not liable for lost profits, lost leads, missed alerts or indirect damages, and our total liability is limited to the amount you paid us in the 12 months before the claim (or [AMOUNT] if you paid nothing). Some places do not allow these limits, so they may not apply to you.

Changes

We may update these terms. We will notify you in the app before material changes take effect. Continuing to use SpeedLead after that means you accept the new terms.
